products and/or services of PICSMAN INC and its affiliates
that use products and/or services provided by PICSMAN INC but
do not have a separate privacy policy. If the PICSMAN INC and
its affiliates have separate privacy policies for the products
and/or services they provide to you, the corresponding privacy
policies will apply to the respective products and/or
services. Please read and thoroughly understand this policy
and make the choices you deem appropriate before using any
PICSMAN INC products and/or services. By using PICSMAN INC 's
products and/or services, you acknowledge that you have fully

products and/or services accessed through our products and/or

• Personal sensitive information: Refers to personal information that may endanger personal
and property safety if leaked, illegally provided or
misused, and is highly likely to lead to damage to
personal reputation, physical and mental health or
discriminatory treatment, etc. This includes personal
property information (bank account numbers, identification
information, transaction and consumption records, flow
records, etc.), personal biometric information, personal
identification information (such as identity cards,
military officer cards, passports, work permits), online
identification information (such as system accounts, email
addresses and the aforementioned related passwords,
passwords, password-protected answers), other information
(personal telephone numbers, sexual orientation, marriage

• Collection: Means the act of gaining control over personal

through sharing, transferring, and collecting public

• Deletion: The act of removing personal information from the system
involved in the realization of daily business functions,
so that it remains unavailable for retrieval and
access.
• Public disclosure: The act of releasing information to the community or to
an unspecified group of people.
• Transfer: The process of transferring the control of personal
information from one controller to another.
• Sharing: Refers to the process of providing personal information
to other controllers by controllers of personal

information unidentifiable without the aid of additional
information through the technical processing of personal

• Affiliated companies: Refers to companies that have an affiliated relationship
with each other. Affiliated relationship refers to the
relationship between the controlling shareholder, the
actual controller, directors, supervisors and senior
management of a company and the companies under their
direct or indirect control, as well as other relationships
that may result in the transfer of interests of the
company.
I. How we collect and use your personal information
(i) How we collect your personal information
We may collect and use your personal information when you use
the products and/or services provided by the PICSMAN INC in
order to better achieve your purposes. This includes:
1. Information you provide when you register for a PICSMAN INC
account
When registering and logging in to your PICSMAN INC account,
you will be required to provide your email address or other
account (Facebook, Google) information, and we will verify the
validity of your account by sending an SMS verification code
or email. You can fill in additional personal information
(avatar, nickname, profile, gender, city, birthday) according
to your needs.
2. Information collected in the course of your use of the
products and/or services
When you use the products and/or services listed in this
Privacy Policy, we may collect information about your device
(including operating system, software version, language
setting, IP address), browsing information (including search
terms, links to pages visited and access times) (including
text, images, videos), location information (including search
for hot movies, events in the same city), transaction
information (including transaction records, address
information provided when purchasing items that need to be
mailed), identity information (including ID numbers, mobile
phone numbers required when authenticating reading authors,
musicians, creators).
3. Information provided by third parties to the PICSMAN INC :
When you use the PICSMAN INC in connection with third party
products and/or services, we may collect information about the
third party products and/or services provided to us.
Such information provided by you will be licensed to us on an
ongoing basis for the duration of your use of the Products
and/or Services. When you cancel your account, we will stop
using and delete the above information.
The above information will be stored within the People's
Republic of China and will not be transferred across borders.
By providing the above information, especially sensitive
personal information, you may be exposed to risks such as
leakage of user information or theft of user accounts, and
difficulties in safeguarding your privacy and property, but we
will do our best to avoid such risks.
If you choose not to provide such information, you may not be
able to register as our user or enjoy certain products and/or
services offered by us, or achieve the intended results of the
relevant products and/or services.
(ii) How we use your personal information
We will use your personal information in the following
circumstances:
1. To provide you with the various products and/or services
you use, and to maintain and improve those services:
(1) Posting features: you can post text, images, videos and we
need to collect the information you post and display your
nickname, avatar and posting content.
(2) Personalisation function: you can browse, follow and
collect the news, diaries, long comments, albums, group posts
and entries that you are interested in. We need to combine
your operational behaviour and analyse it through algorithms
to make personalised recommendations, display or push you
specific information that you may be interested in. Some of
the information may not be your preferred information.
(3) Search function: You can use the service of querying
keywords. We need to use network storage mechanism and
application data cache to collect the information on your
device and store it locally to provide more convenient search
service.
(4) Location function: You can use services related to
geographic location. PICSMAN INC hometown and PICSMAN INC
movie products need to collect your location information to
provide goods or services in your area.
(5) Authentication: You can use authentication services. When
you apply for "PICSMAN INC Creator", we need to collect your
name and valid ID to verify your identity. Once the
information has been verified, we will provide you with a
certification mark for your personal account.
(6) Trading function: You can activate the "Appreciation
function" to use the payment service. When you wish to
purchase products, online courses, e-books, columns or use
official hometown services that require payment, you will need
to use the "Payment Function". During the payment collection
process, we will need to collect your ID number, payment
method and third party payment account number (including
Alipay account, Apple Pay account or other forms of bank card
information) in order to provide an efficient transaction
service.
(7) Marketing activities: You can participate in online or
offline marketing activities organised by us or third parties,
including advance movie viewing, offline salons, exhibitions
and bazaars, and we will collect your mobile phone number,
user ID and real name with your consent to provide a better
experience of the activities.
(8) Customer service function: You can initiate complaints,
grievances or enquiries to our customer service, we need your
real name, mobile phone number and email. Timely feedback to
you on the outcome of your complaint, grievance or enquiry,
and if the complaint is made in your personal name, you will
also need to provide identification.
(9) For other purposes with your consent, including but not
limited to sending you information about our products and
services, or showing you personalised third party promotions
through the system, or sharing information with our partners
with your consent so that they can send you information about
their products and services. Some of the information may be
information that you do not wish to receive.
2. You should be reminded that your consent is not required
for the use of your personal information in the following
circumstances:
(1) In connection with the performance of obligations imposed
by laws and regulations by the controller of personal
information
(2) Directly related to national security or defence security
(3) Directly related to public safety, public health, or vital
public interests
(4) Directly related to criminal investigation, prosecution,
trial and execution of judgments, etc.
(5) Where it is necessary to protect the life, property and
other significant legitimate rights and interests of the
subject of the personal information or other individuals but
it is difficult to obtain their consent.
(6) Where the personal information collected is disclosed by
you to the public at your own discretion.
(7) Where your personal information is collected from
information that has been lawfully and publicly disclosed,
such as lawful news reports, government information disclosure
and other channels.
(8) That is necessary for the conclusion and performance of a
contract at your request
(9) Necessary for maintaining the safe and stable operation of
the products and/or services provided, such as detecting and
dealing with faults in products and/or services.
(10) Where necessary to carry out statistical or academic
research in the public interest and to de-identify personal
information contained in the results of the academic research
or descriptions provided to the public.
II. How we use cookies and similar technologies
(i) Cookies
The use of cookies helps you to personalise your online
experience by allowing you to accept or decline cookies, most
web browsers automatically accept cookies, but you can usually
modify your browser settings to decline cookies if you wish.
Cookies do not track personal information.
The PICSMAN INC also uses cookies when you register with the
PICSMAN INC, in which case the PICSMAN INC collects and stores
useful information that allows us to identify you when you
visit the PICSMAN INC again. Cookies from the PICSMAN INC can
only be read by the PICSMAN INC. If your browser is set to
refuse cookies, you will still be able to access most pages on
the PICSMAN INC.
(ii) Web beacons and pixel tags
In addition to cookies, we use other similar technologies such
as web beacons and pixel tags on our website. For example, an
email we send you may contain a click-through URL that links
to content on our website, and if you click on that link, we
track that click to help us understand your product or service
preferences and improve customer service. A web beacon is
usually a transparent image that is embedded in a website or
email. With the help of pixel tags in emails, we can tell if
an email has been opened. If you do not want your activity to
be tracked in this way, you can unsubscribe from our mailing
list at any time.
(iii) Do Not Track
Many web browsers have a Do Not Track feature which issues Do
Not Track requests to websites. Currently, the major Internet
standards organisations do not have policies in place to
govern how websites should respond to such requests. However,
if your browser has Do Not Track enabled, then our websites
will respect your choice.
III. How we share, transfer and publicly disclose your
personal information
We are fully aware of our legal liability for damage to the
subject of personal information caused by the unlawful
sharing, transfer or public disclosure of personal
information, and we will conduct all sharing, transfer or
public disclosure of your personal information in strict
accordance with the following terms:
(i) Sharing
Respect for the privacy of individual users is a fundamental
principle of the PICSMAN INC. We will not share your personal
information with any company, organisation or individual
except in the following circumstances:
1. Sharing with express consent: we will share your personal
information with other parties after obtaining your express
consent.
2. We may share your personal information with external
parties as required by judicial or administrative authorities.
3. Shared with our affiliates: your personal information may
be shared with affiliates of the PICSMAN INC. We will only
share personal information that is necessary and is subject to
the purposes stated in this Privacy Policy. If an associated
company wishes to change the purposes for which personal
information is processed, your authorised consent will be
sought again.
4. Sharing with Authorised Partners: Certain of our products
and/or services will be provided by authorised partners for
the sole purpose of achieving the stated purposes in this
policy. We may share some of your personal information with
our partners in order to provide better customer service and
user experience. We will only share your personal information
for lawful, legitimate, necessary, specific and explicit
purposes, and only as much personal information as is
necessary to provide the products and/or services, and will
enter into strict confidentiality agreements with the
companies, organisations and individuals with whom we share
personal information, requiring them to handle it in
accordance with our instructions, this Privacy Policy and any
other relevant confidentiality and security measures.
Currently, our partners include.
(1) Third-party merchants with whom the Platform partners: To
help you make purchases of products or services (including
your purchase of products on PICSMAN INC Reading and Companion
Pet Paradise) or to provide you with after-sales service, we
may share your order and transaction-related information with
third-party merchants on the Platform.
(2) Third-party logistics service providers: When you
successfully place an order, if the goods require third-party
delivery, we will share your information with the third-party
logistics company on a minimal and necessary basis in order to
accurately and safely complete the delivery and distribution
of the goods to you. We promise that the information will only
be used for the purpose of delivery.
(ii) Transfer
We will not transfer your personal information to any company,
organisation or individual, except for the following:
1. Transfer with express consent: we will transfer your
personal information to other parties after obtaining your
express consent.
2. In the event of a merger, acquisition or bankruptcy and
liquidation involving the transfer of personal information, we
will require the new company or organisation holding your
personal information to continue to be bound by this privacy
policy before we require that company or organisation to seek
authorised consent from you again.
(iii) Public Disclosure
We will only disclose your personal information publicly with
your express consent, except as necessary for the maintenance
of the PICSMAN INC Community, to announce penalties for
accounts that violate the rules, fraud, abuse or other serious
damage to the PICSMAN INC Community (such as posting a link to
the home page of the penalized account), or to display
relevant information when announcing a winner/winners list.
(iv) Exceptions to the authorization of consent for sharing,
transferring, or publicly disclosing personal information
In accordance with the provisions of laws and regulations,
prior authorised consent is not required for the sharing,
transfer or public disclosure of your personal information in
the following circumstances:
1. In connection with the performance of our obligations under
laws and regulations.
2. Directly related to national security or defence security.
3. Directly related to public safety, public health, or vital
public interests.
4. Directly related to criminal investigations, prosecutions,
trials and enforcement of judgments, etc.
5. For the purpose of safeguarding your or other individuals'
significant legitimate rights and interests such as life and
property but where it is difficult to obtain your consent.
6. Personal information that you disclose to the public on
your own initiative.
7. Personal information collected from legitimate public
disclosures, such as legitimate news reports, government
information disclosure and other channels.
IV. How we protect your personal information
• We have used security measures in line with industry
standards to protect the personal information you provide
against unauthorised access, public disclosure, use,
modification, damage or loss of data. We will take all
reasonably practicable steps to protect your personal
information. For example, the exchange of data between
your browser and the Service (e.g. credit card
information) is protected by SSL encryption; we also
provide https secure browsing on the PICSMAN INC site; we
use encryption technology to ensure the confidentiality of
data; we use trusted protection mechanisms to prevent
malicious attacks on data; and We will deploy access
control mechanisms to ensure that only authorised
personnel have access to personal information; and we will
conduct security and privacy training courses to enhance
staff awareness of the importance of protecting personal
information.
• We will take all reasonably practicable steps to ensure
that no unrelated personal information is collected.
Unless we have your written permission, we will retain
your personal information for 36 months after you delete
or cancel your account, after which time your personal
information will be anonymised or destroyed.
• The Internet is not an absolutely secure environment and
as email, instant messaging and communication with other
users of the PICSMAN INC is not encrypted, we strongly
recommend that you do not send personal information by
such means. Please use complex passwords to help us keep
your account secure.
• The Internet environment is not 100% secure and we will
endeavour to ensure the security of any information you
send to us. We will be liable for any breach of our
physical, technical or managerial safeguards that results
in unauthorised access, public disclosure, alteration or
destruction of information, resulting in damage to your
legitimate rights and interests.
• After the unfortunate occurrence of a personal
information security incident, we will promptly inform you
of: the basic situation and possible impact of the
security incident, the disposal measures we have taken or
will take, suggestions for you to prevent and mitigate
risks on your own, remedial measures for you, etc. in
accordance with the provisions of Article 42(2) of the
“Network Security Law”. We will promptly inform you of the
relevant circumstances of the incident by email, letter,
telephone, push notification, etc. When it is difficult to
inform the subjects of personal information individually,
we will take reasonable and effective ways to make
announcements. At the same time, we will also take the
initiative to report the disposal of personal information
security incidents in accordance with the requirements of
the regulatory authorities.
V. Your rights
Whenever you use the relevant products and/or services of the
PICSMAN INC, we will do everything possible to ensure that you
have smooth access to your account information. If such
information is incorrect, we will endeavour to provide ways
for you to quickly update or delete the information in your
account. In order for you to have the full ability to
safeguard your privacy and security, you have the following
rights:
(i) Access to your personal information
You have the right to access your personal information at any
time, unless otherwise required by a judicial or
administrative authority. This includes information such as:
1. Account information.
If you wish to access or edit your name/nickname, domain name,
avatar, login email, mobile phone number, privacy settings,
etc. in your account, you can perform such operations by
accessing the personal account settings function of the APP or
website.
2. Usage information.
You can access your usage information at any time on the
relevant product pages, including: broadcast release content,
book and video recordings, group discussions, etc.
If you are unable to access through the above links and
methods, you can always contact us and we will respond to your
request as soon as possible.
(ii) Correction of your personal information
If you discover an error in the personal information you have
provided or that we have processed about you, you have the
right to correct it yourself. If you are unable to do so, you
may contact us at any time and we will respond to your request
for correction as soon as possible.
(iii) Deletion of your personal information
You have the right to delete your personal information at any
time by yourself or by contacting us to delete your personal
information. You may make a request to us to delete personal
information in the following circumstances:
1. Our handling of personal information violates laws and
regulations.
2. We collect and use your personal information without your
consent.
3. Our handling of personal information violates our agreement
with you.
4. You no longer use our products or services, or you have
cancelled your account.
5. We no longer provide products or services to you.
If we decide to respond to your request for erasure, we will
also notify the entities that have obtained your personal
information from the PICSMAN INC in a cooperative manner and
ask them to delete it promptly, unless they have otherwise
obtained your independent authorization. Please be aware,
however, that if your publicly available information on the
PICSMAN INC is crawled, cached, stored, copied, or uploaded or
stored on other websites by other users or by independent
third parties who are not affiliated or associated with us and
are not under our control, the information will not be under
the control of the PICSMAN INC.
When you delete your personal information from our services,
we will also delete the corresponding information from our
backup systems.
If we cease operations for reasons such as business failure,
we will immediately stop collecting your corresponding
personal information and delete the personal information we
have collected.
(iv) Change of the scope of your authorized consent or
withdrawal of your authorization
Each business function requires some basic personal
information in order to be completed (see "Part I" of this
policy). You may give or withdraw your consent to the
collection and use of additional personal information at any
time. You can change or withdraw your consent for us to access
your location, photos, camera, etc. by deleting the
information, turning off the corresponding function on your
mobile device (e.g. iOS users can change or withdraw your
consent for us to access your location, photos, camera, etc.
by going to "Settings" - "PICSMAN INC" App, e.g. Android users
can change or withdraw their authorization via "Settings" -
"Apps" - "Manage Permissions" - "PICSMAN INC You can change or
revoke your authorization via "Settings" - "Apps" - "Manage
Permissions" - "PICSMAN INC". By changing the scope of your
consent or withdrawing your consent. When you withdraw your
consent, we will no longer process the corresponding personal
data. However, your decision to withdraw your consent will not
affect the processing of personal data previously carried out
on the basis of your authorisation.
(v) Cancellation/deletion of accounts
You may choose to cancel/delete your account with PICSMAN INC.
Your account will not be restored after cancellation/deletion
and your personal information will be deleted or anonymised.
Your mobile phone number will be automatically unbonded after
the cancellation/deletion and you can then bind it to another
PICSMAN INC account. If you are sure you want to cancel your
account, you can do so by following the instructions on the
PICSMAN INC website via "xxx's Account" - "Account Management"
- "Delete Account", or in the PICSMAN INC App via "Settings" -
"Account & Security" - "PICSMAN INC Security Centre" -
"Cancel Account".
(vi) Obtaining a copy of your personal information
Upon your written request, we will provide you with copies of
the following types of personal information: your basic
personal information, personally identifiable information.
Please note, however, that the copies of information we
provide to you are limited to the information we collect.
(vii) Binding information systems for automated
decision-making
In some business functions, we may make decisions based solely
on non-human automated decision-making mechanisms, including
information systems, algorithms, etc. If these decisions
significantly affect your legitimate interests, you have the
right to seek an explanation from us and we will provide
appropriate remedies.
(viii) Responding to your request above
For security purposes, you may need to provide a written
request or otherwise prove your identity. We may ask you to
verify your identity before processing your request. We will
respond within fifteen working days. If you are not satisfied,
you can also complain at
support@picsman.ai. In principle, we do not charge a fee for your reasonable
requests, but we will charge a cost fee for repeated requests
that exceed reasonable limits, as appropriate. We may refuse
requests that are unwarrantedly repetitive, require excessive
technical means (for example, requiring the development of new
systems or fundamental changes to current practice), pose a
risk to the legitimate interests of others or are highly
impractical (for example, involving backing up information
stored on tape).
In the following cases, we will not be able to respond to your
request in accordance with legal and regulatory requirements:
1. In connection with the fulfilment of the obligations of the
controller of personal information as required by law or
regulation.
2. Directly related to national security or defence security.
3. Directly related to public safety, public health or vital
public interests.
4. Directly related to criminal investigation, prosecution,
trial and execution of judgments.
5. Where there is sufficient evidence of subjective malice or
abuse of your rights.
6. Response to your request will lead to serious damage to the
legitimate rights and interests of you or other individuals or
organizations.
7. For the purpose of safeguarding the life, property and
other significant legitimate rights and interests of you or
other individuals but where it is difficult to obtain my
authorised consent.
8. Where commercial secrets are involved.
VI. Personal information about children
Our products and/or services are primarily intended for
adults. Minors are not allowed to create their own user
accounts without the consent of their parents or guardians. In
the case of personal information collected from minors with
parental consent, we will only use or publicly disclose this
information if required by a judicial or administrative
authority, with the express consent of the parent or guardian,
or when necessary to protect the minor.
Although local laws and customs define minors differently, we
consider anyone under the age of 16 to be a minor.
If we become aware that we have collected personal information
from a minor without prior verifiable parental consent, we
will seek to delete the relevant data as soon as possible.
VII. Our biometric policy
When you use Picsman tools and apply effects to, or generate
images of, your face, you understand and agree that Picsman
may use facial geometry or other facial data to produce the
image or effect you request. We refer to this as “biometric
data.” Our technology uses this biometric data to provide the
applicable services to you and to improve Picsman. We never
use this biometric data to identify any individual person or
for authentication purposes.
We only collect, use and store your biometric data in
accordance with this Privacy Policy. In addition, we will only
disclose your biometric data in accordance with the section
above entitled “How we share, transfer and publicly disclose
your personal information” and, where required by applicable
law, you consent to such disclosure. We will not sell, lease,
trade, or otherwise profit from your biometric data.
We store your biometric data using a reasonable standard of
care and in a manner that is the same or exceeds the standards
used to protect other confidential and sensitive information
we may hold.
We will destroy your biometric data upon the earliest of:
1. The date when our purpose for collecting or obtaining your
biometric data has been satisfied.
2. Termination of your Picsman account.
We may, however, retain your biometric data for a longer
period of time if required by law or required by valid legal
subpoena. We have established the following guidelines for
permanently destroying biometric information, subject to the
retention period in the prior sentence: as appropriate and
applicable, Picsman will permanently destroy your biometric
information by deleting or otherwise removing such information
from our records in line with industry best practices at the
time of the destruction or as otherwise directed by applicable
law.
VIII. How the app uses face data about AI service
Our products and services that involve facial data
functionality pertain to the AI creation service. The facial
images uploaded for this service will only be used for this
specific service; after you close the activity page, Our
products and services will not retain or share the images you
have uploaded with any third parties. For more detailed terms
related to AI services, please refer to the “
AI Creation Service Agreement”.
IX. How this policy is updated
Our privacy policy will be updated from time to time. If we
make material changes, we may notify you through other methods
as required by law, such as at Picsman website, in our mobile
applications, by sending email to the email address associated
with your account, or by push notifications to your device if
you’ve enabled them. If you continue to use Picsman after
those changes are in effect, you agree to the new policy.
